These Terms of Service ("Terms") govern your use of PropCalc, operated by the site operator, an address to be published here once the operator’s legal entity is finalized ("PropCalc", "we", "us"). By visiting this site or using any calculator on it, you agree to these Terms. If you do not agree, please do not use the site.
License to Use
We grant you a personal, non-exclusive, non-transferable, revocable license to access and use PropCalc's calculators for your own personal or internal business purposes, on any device, free of charge. This license does not include the right to resell access to the site, to scrape or systematically extract its content for a competing product, to reverse engineer the calculators beyond what's needed for your own personal understanding, or to remove any copyright, trademark, or other proprietary notice.
Acceptable Use
You agree not to:
- use the site for any unlawful purpose, or in a way that violates any applicable local, state, national, or international law;
- attempt to gain unauthorized access to any part of the site, its infrastructure, or any account or system connected to it;
- interfere with or disrupt the site's operation — for example, through denial-of-service attacks, automated scraping at a rate that degrades the service for other users, or the introduction of malware;
- misrepresent PropCalc's outputs as your own proprietary analysis when redistributing them commercially, without attribution; or
- use the site's contact channels to send spam, phishing attempts, or unsolicited commercial messages unrelated to PropCalc.
Intellectual Property
The PropCalc name, logo, site design, calculator interfaces, and original written content are owned by the site operator or its licensors and are protected by copyright, trademark, and other intellectual property laws. The underlying financial formulas the calculators implement (amortization, cap rate, cash-on-cash return, debt-to-income ratios, and similar standard real-estate and lending math) are not proprietary to PropCalc — they are published, generally known methods — but our particular implementation, presentation, and the site's content are ours. Nothing in these Terms transfers any of that ownership to you.
No Financial, Tax, or Legal Advice
PropCalc is an educational tool. Every number a calculator produces is an estimate built strictly from the inputs you provide and a standard formula — it is not financial, tax, legal, or investment advice, and it is not a recommendation to buy, sell, finance, or otherwise transact in any property. See our Disclaimer for the full statement of these limits, which is incorporated into these Terms by reference.
Disclaimer of Warranties
The site and its calculators are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and without any warranty that the site will be uninterrupted, error-free, or produce results that match any specific lender's, appraiser's, or professional's calculation for the same inputs.
Limitation of Liability
To the fullest extent permitted by law, the site operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of, or inability to use, PropCalc — including any decision made in reliance on a calculator's output — even if we have been advised of the possibility of such damages.
This limitation does not apply to, and nothing in these Terms limits or excludes, liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; gross negligence or willful misconduct; or any other liability that cannot lawfully be limited or excluded under the law that applies to you. Where a court finds any part of this limitation unenforceable as to a particular type of liability, that finding does not affect the rest of this limitation.
Indemnity
You agree to indemnify and hold harmless the site operator, its operators, and anyone acting on its behalf from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the site, or your violation of any right of a third party — except to the extent such claim arises from our own breach of these Terms or violation of applicable law.
Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. You may stop using the site at any time. Provisions that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnity, and Governing Law — survive any termination of your access.
Governing Law and Venue
These Terms are governed by the laws of a jurisdiction to be specified once the operating entity is finalized, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of any protection you are entitled to under the mandatory consumer-protection law of your own country of residence, where such law applies and cannot be waived by agreement.
Changes to These Terms
We may revise these Terms from time to time, most often to reflect a change in the site (such as advertising going live) or in applicable law. The "Last updated" date at the top of this page reflects the most recent revision. Continuing to use the site after a revision takes effect constitutes acceptance of the revised Terms; if you do not agree with a revision, your remedy is to stop using the site.
